Since May 25, 2018, the General Data Protection Regulation (GDPR) has been in force throughout the European Union. These regulations harmonize privacy laws within the EU, creating additional obligations and responsibilities for organizations. In the Netherlands, the AVG is further supported by the AVG Implementation Act. At the same time, data subjects’ privacy rights are significantly strengthened, with heavy fines for non-compliance. In addition, privacy laws are being further tightened by the upcoming ePrivacy Regulation, which will replace the current cookie law.

At Guldemond Lawyers, we support companies and organizations in implementing the AVG and offer advice and legal assistance on privacy-related issues, including data breaches, protection of personal data, and legal questions surrounding technologies such as artificial intelligence (AI), big data and blockchain. Our expertise extends to both compliance issues and proceedings before the regulator, the Personal Data Authority.

Our privacy lawyers have extensive experience and provide support in the following areas:

  • AVG implementation and compliance: we assist companies in drafting privacy policies, data breach protocols and processor agreements, and provide training on the AVG.
  • Compliance audits: through an AVG scan, we assess your organization’s compliance and offer recommendations to achieve full compliance.
  • Data breaches and security: we advise on data breaches and security breaches and assist in reporting data breaches to the regulator.
  • Disputes with the Personal Data Authority: we offer legal assistance in disputes with the regulator, for example in the case of an investigation or imposition of fines by the Personal Data Authority.
  • Processor agreements: we handle disputes and advisory processes around processor agreements, focusing on technical and organizational security measures.
  • Privacy in the workplace: we offer advice on privacy-related issues in the workplace, such as camera surveillance, monitoring email traffic or processing data on sick employees.
  • Privacy law and the Internet: we help you draft privacy statements, cookie policies and comply with regulations regarding online data processing, including the rules of the ePrivacy Regulation.
  • Deletion requests and right to be forgotten: we support clients in submitting deletion requests to Google or other platforms, and assist in exercising rights under the AVG, such as the right to inspect and the right to be forgotten.
